General provisions
This Privacy Policy (the "Policy") governs personal data processing by the operator of the CASANES digital platform (the "Controller" or "CASANES"), within the temporary boutique rental marketplace located primarily in Ciudad Autónoma de Buenos Aires, Argentina. Using the website, creating an account, listing properties, or making bookings implies knowledge of this Policy. To exercise rights or ask questions about personal data, contact exclusively: casanesinfo@gmail.com.
1. Definitions
For this Policy: (i) "Personal data": any information relating to identified or identifiable natural persons, under Argentine Law No. 25,326 and supplements; (ii) "Data subject": the natural person whose data is processed; (iii) "Processing": any operation on personal data (collection, storage, use, disclosure, deletion, etc.); (iv) "Processor": third party processing data on behalf of the Controller; (v) "Platform": the website and digital services operated under casanes.com and associated subdomains.
2. Data categories, purposes, and legal bases
2.1. Guests. We may process: name; email; phone; ID or passport (including image/file for verification); booking data (dates, property, amounts, messages to host); payment transaction identifiers; and, where applicable, data from Google authentication per permissions granted. Purposes: contractual relationship; identity verification before check-in; payment processing; safety; inquiries; legal compliance; Platform operations. 2.2. Owners (publishers). We may process: identity and contact data; property information; tax and payout data when applicable; records of terms acceptance; identifiers linked to payout integrations (e.g. Mercado Pago or Stripe Connect). Purposes: listing management; bookings and settlements; compliance; fraud prevention; support. 2.3. Browsing. Technical usage data (IP, device/browser type, cookies per section 8). Legal bases: contract or pre-contractual measures; legal obligation; legitimate interest (security, Platform integrity, claims defense); consent where required (e.g. external sign-in or non-essential cookies).
3. Processors and international transfers
CASANES may rely on processors acting on the Controller's instructions, including infrastructure and database (Supabase); hosting (Vercel); payments (Stripe, Mercado Pago); authentication (Google / Supabase Auth); and transactional email. Some infrastructure may be outside Argentina. CASANES will adopt reasonable safeguards, including standard contractual clauses where applicable.
4. Security measures
CASANES implements technical and organizational measures appropriate to the data processed, including encryption of ID documents at rest (AES-256-GCM), TLS/HTTPS transmission, access controls, and environment segregation where appropriate. No system is absolutely secure. The data subject acknowledges security also depends on credential and device custody. CASANES does not sell or rent personal data to third parties for marketing unrelated to the service.
5. Retention period
Personal data is retained as long as necessary for stated purposes and applicable legal obligations, including tax and accounting retention in Argentina, payment disputes, and judicial or administrative proceedings. After those periods, data is deleted or anonymized unless a legal duty to retain remains.
6. Disclosure and assignment
Data disclosure is limited to processors, payment partners strictly necessary for operations, and competent authorities when legally required or upon valid request. Data will not be assigned to third parties for commercial purposes unrelated to the service without express consent or legal basis.
7. Data subject rights
7.1. Argentina. Under Law No. 25,326, the data subject may request access, rectification, update, or deletion by writing exclusively to casanesinfo@gmail.com, and may file a complaint with the Public Information Access Agency (AAIP). 7.2. EU/EEA. Where GDPR applies, the data subject may exercise applicable rights (access, rectification, erasure, restriction, portability, objection) via the same contact. 7.3. United States. Where state privacy laws apply (including CCPA-type rules), CASANES will respond to information, access, and deletion requests as required by law and the nature of the service. CASANES may request reasonable identity verification before fulfilling a request.
8. Cookies and similar technologies
The Platform uses technical cookies and local storage strictly necessary for service operation, including authenticated sessions and geographic filter preferences in the catalog. Third-party behavioral advertising cookies are not used. Session cookies use security attributes such as HttpOnly and Secure in production when the browser allows. The data subject may block cookies in the browser; this may affect sign-in or booking.
9. Minors
The Platform is not directed to persons under 18. CASANES does not knowingly request data from minors. If improper processing of minors' data is discovered, it will be deleted per applicable law.
10. Changes, governing law, and contact
CASANES may amend this Policy to reflect legal or service changes. The current version is published at https://casanes.com/privacidad with the last update date. Unless mandatory rules in the data subject's jurisdiction provide otherwise, this Policy is governed by the laws of the Argentine Republic. Disputes are submitted to the ordinary courts of the Autonomous City of Buenos Aires, without prejudice to mandatory consumer protection rules.
