Terms and conditions

General provisions

These Terms and Conditions (the "Terms") govern access to and use of the CASANES digital platform (the "Platform"), operated from Ciudad Autónoma de Buenos Aires, Argentina. By browsing, registering, listing a property, or confirming a booking, the User declares having read, understood, and fully accepted these Terms, the Privacy Policy, and the applicable cancellation policy. If you disagree, you must not use the Platform. CASANES may update these Terms; the version published at https://casanes.com/terminos prevails from its effective date.

1. Nature of the service and intermediation

CASANES acts solely as a technology intermediary facilitating contact, bookings, and—where applicable—payment processing between guests ("Guests") and owners or hosts ("Hosts"). Unless expressly stated on a listing, CASANES is not the owner, lessor, hotel operator, travel agent, or insurer of listed properties.

  • The lodging contract is entered into directly between Guest and Host; CASANES is not a party except for units expressly operated by the platform.
  • Photos, descriptions, house rules, and particular conditions are provided by the Host, who warrants their accuracy and legality.
  • CASANES does not guarantee continuous Platform availability, absence of technical errors, or suitability of a property for a particular purpose of the Guest.

2. Bookings and payments

Payments are processed through authorized providers (Stripe, Mercado Pago, or others shown at checkout). Platform commission and Host net breakdown is disclosed before confirmation. The Guest authorizes charges according to amounts shown, including cleaning fees and additional charges communicated in the booking.

  • Minimum stay on the Platform is 2 nights per booking.
  • 72 hours before check-in (15:00 (Argentina)) we email you to confirm your stay. If you do not respond within 4 hours, we resend; if still unconfirmed, a third notice 6 hours later. At 49 hours before, the booking is confirmed and 100% of the remaining balance is charged. You may cancel up to 48 hours before (one night penalty only).

3. Cancellations

Reference check-in: 15:00 (Argentina). 72 hours before check-in we email you to confirm your stay; if you do not respond within 4 hours, we send a second email; if you still do not confirm, a third notice 6 hours after the second. 49 hours before check-in the booking is confirmed and the full remaining balance is charged. You may cancel up to 48 hours before (one night penalty only).

  • Up to 48 hours before check-in (15:00 (Argentina)): the guest may cancel the full booking. Only one night is retained (total ÷ nights); the rest is refunded and the calendar is released.
  • 72 hours before check-in: we send an email for the guest to confirm the stay. If there is no response within 4 hours, a second email; if still unconfirmed, a third 6 hours after the second.
  • 49 hours before check-in: the stay is fully confirmed (whether or not the guest replied to the email) and the remaining balance (100%) is charged.
  • After 48 hours before check-in there is no cancellation.
  • Minimum stay of 2 nights per booking on the Platform.

4. Personal property, security, and crimes on the premises

The Guest acknowledges staying at the property at their own risk and that of their companions. CASANES does not provide custody, surveillance, physical security, or safekeeping of belongings within properties.

  • To the maximum extent permitted by applicable law, CASANES is not liable for theft, robbery, loss, damage, or destruction of personal belongings, luggage, cash, jewelry, documents, vehicles, electronics, or other property of the Guest or third parties, inside the property, common areas, public spaces, or anywhere linked to the stay, regardless of cause.
  • Custody, safekeeping, and insurance of the Guest's belongings are the Guest's sole responsibility, who should take reasonable precautions (locks, not sharing access codes, not leaving valuables in sight, obtaining travel or home insurance if needed).
  • CASANES does not replace police, the Host, or insurers. In case of crime or security incident, the Guest must report to competent authorities and notify the Host promptly.
  • Any assistance CASANES may provide after incidents is purely collaborative and does not imply liability or an obligation to indemnify.

5. Property damage and Guest conduct

The Guest is responsible for their conduct and that of companions throughout the stay. CASANES expressly disclaims liability for damage, deterioration, contamination, loss, theft, or robbery to the property, fixtures, furniture, appliances, equipment, Host belongings, or third-party property when attributable to the Guest, their invitees, pets, or anyone the Guest allowed entry.

  • The Guest must use the property according to house rules, applicable law, and good customs, avoiding unauthorized parties, misuse of facilities, smoking where prohibited, and any act causing nuisance or damage.
  • The Host—not CASANES—is the primary contact to claim repair or replacement for Guest-caused damage, without prejudice to dispute tools the Platform may offer as a facilitator.
  • The Guest authorizes CASANES to share with the Host data reasonably necessary to handle damage claims (identity, contact, booking details), as permitted by the Privacy Policy.

6. Indemnity

To the maximum extent permitted by applicable law, the User (Guest, Host, or registered visitor) agrees to hold harmless, defend, and indemnify CASANES, its directors, partners, employees, collaborators, and technology providers from any claim, demand, fine, sanction, damage, loss, cost, or expense (including reasonable professional fees) arising from: (i) breach of these Terms; (ii) stay, conduct, or damage caused by the Guest or companions; (iii) inaccurate information provided by the User; (iv) violation of third-party rights or applicable law; or (v) disputes between Guest and Host, unless CASANES acted with proven direct intent.

7. Limitation of CASANES liability

The following limitations are essential elements of the agreement between the User and CASANES. If applicable law does not allow an exclusion or limitation, it applies only to the maximum extent permitted.

  • Except for express obligation to transmit payments to the Host under these Terms, CASANES (including affiliates and personnel) shall not be liable for indirect, incidental, special, punitive, or consequential damages, including—without limitation—lost profits, data loss, goodwill, service interruption, personal injury, emotional distress, or cost of substitute products or services, arising from use or inability to use the Platform, a booking, communications between Users, or provision or use of the property, under any theory, even if CASANES was advised of the possibility of such damages.
  • Aggregate liability of CASANES for any claim related to these Terms, the Platform, or a booking shall not exceed, per Guest, amounts actually paid for that booking through the Platform; per Host, net amounts received for that booking in the twelve (12) months before the claim; and otherwise, the Argentine peso equivalent of one hundred US dollars (USD 100) or the minimum non-reducible by law.
  • CASANES does not warrant that Hosts fulfill obligations, that properties are free of hidden defects or risks, or that building or neighborhood security measures meet Guest expectations.

8. No insurance coverage

CASANES is not an insurance company. Unless expressly stated otherwise in writing, the Platform does not provide property damage, guest liability, cancellation, or theft coverage. Guests and Hosts must obtain, at their own risk, coverage they deem appropriate. Any future protection or dispute program offered by CASANES will be governed by separate conditions and will not replace these Terms or an insurance policy.

9. ATT registration (CABA)

Units in the City of Buenos Aires must have a Temporary Tourist Rental Registration number (Law 6255) when applicable. That number is shown on the listing. The Host is responsible for obtaining and maintaining it.

10. Governing law, consumers, and jurisdiction

These Terms are governed by the laws of the Argentine Republic. For disputes with CASANES, the parties submit to the ordinary courts of the Autonomous City of Buenos Aires, waiving any other forum, subject to mandatory consumer protection rules (Law No. 24,240 and supplements) applicable to the Guest as consumer that cannot be validly limited by contract. 11. Hosts — tax responsibility and disclaimer

This section applies to those who list or intend to list spaces on CASANES as hosts or owners.

  • The owner/host is solely responsible before the Federal Administration of Public Revenue (ARCA), provincial and municipal agencies, the Central Bank of Argentina, financial institutions, and any supervisory authority for the tax treatment of income from temporary rentals or lodging, including—income tax, VAT, gross receipts, personal property tax, and other taxes as applicable.
  • CASANES acts solely as a technology intermediary for bookings and payments. It is not a withholding or collection agent for the owner, does not replace the owner in tax obligations, and does not advise or guarantee the host's tax compliance.
  • CASANES expressly disclaims liability for tax returns, filings, reports, account reconciliations, accounting books, electronic invoicing, registrations, or communications the owner must make to ARCA, AFIP (historical name), banks, Argentine entities, or abroad.
  • Gross, net, commission, and breakdown amounts shown in the panel are operational references of the platform; they do not constitute accounting advice or a substitute for tax documents issued by the owner under applicable law.
  • The owner declares valid CUIT/CUIL/CDI and tax data, issues—when required—documents to the guest or as required by law, and shall hold CASANES harmless from claims, fines, sanctions, or audits arising from temporary rental activity.
  • The owner is solely responsible for the condition, safety, and upkeep of the property, theft or robbery inside it, and damage caused by guests; CASANES does not guarantee insurance coverage or damage repair, and the host shall hold CASANES harmless from guest or third-party claims related to the property, except proven direct intent by the platform.
  • Acceptance of these terms when registering or before listing a space is required to use the publishing panel.
